Terms of Service
The agreement for using ITSPracticing: accounts, your work, AI features, and our responsibilities.
Effective · Last updated
1. The agreement
These Terms of Service (the “Terms”) govern your use of ITSPracticing (the “Service”), operated by ITSPracticing, Yıldız, Çırağan Cd., 34349 Beşiktaş/İstanbul, Türkiye (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Most people use ITSPracticing because a university or company (an “Institution”) has invited them. The Institution has its own agreement with us, including the Data Processing Agreement. Where that agreement conflicts with these Terms, that agreement prevails for the Institution and its users.
2. What the Service is
ITSPracticing lets learners practise operations, information-technology, software and security work inside simulated organisations: they investigate documents, use tools, make decisions and see the consequences, and their instructors review that work.
Everything inside a simulation is fictional. Companies, people, email addresses, orders, machines, systems and incidents are invented for teaching. Any resemblance to real organisations or people is coincidental. Do not load real company data, real personal data or real credentials into a simulation unless your Institution has a separate written agreement with us that allows it.
3. Accounts
- Accounts are created by invitation. Creating an account does not by itself give you access to any course or organisation; access comes from your Institution.
- You must give accurate information and keep your sign-in details secret. You are responsible for activity on your account. Tell us at once if you suspect someone else has used it.
- You must be at least 16 years old, or older where the law of your country requires a higher age to consent to online services. Institutions that admit younger learners are responsible for obtaining any consent the law requires.
- One person, one account. Do not share an account or sign in as someone else, except through the demonstration personas we provide in development builds.
4. Institutions and their users
An Institution decides who is invited, which courses and missions they take, which practice modes and AI features are enabled, how long recordings are kept, and who may review learners' work. Instructors and administrators at your Institution can see your attempts, decisions, evaluations and session recordings within their scope, as described in the Privacy Notice. Grades and academic decisions are made by your Institution, not by us.
If your Institution's access ends, your access through it ends too. Questions about your course, your assessment or your data held for your Institution should go to your Institution first.
5. Using the Service properly
You must follow the Acceptable Use Policy. In particular, do not attack, probe or overload the Service (security research is welcome, but only under our disclosure policy), do not try to see other people's data, and do not misrepresent work as your own where your Institution requires independent work.
6. Your work and our content
Your work
Findings, decision briefs, messages, notes and other material you create (“Your Work”) remain yours, or your Institution's where your arrangement with it says so. You give us a non-exclusive, worldwide licence to host, store, process, display and transmit Your Work only as needed to provide the Service to you and your Institution, including showing it to the reviewers your Institution authorises. We do not sell Your Work and do not use it to train AI models.
Content authored by instructors
Missions and scenarios written by instructors belong to them or their Institution. By publishing them in the Service, they give us the licence needed to run them for the people they are assigned to. Authors are responsible for having the rights to what they upload.
Our content
The Service, its software, design, built-in missions, simulated worlds and documentation belong to us or our licensors. We give you a personal, non-transferable, revocable licence to use them for learning and teaching through the Service for as long as you have access. You may not copy, resell or redistribute them, or use them to build a competing product.
Feedback
If you send us suggestions, we may use them without obligation to you.
7. AI features
Some features may use an AI model, for example a fictional colleague replying to your email, a coach offering a hint, or a draft mission for an instructor. These features are switched on or off by your Institution; the default is off. AI output can be wrong, incomplete or inconsistent; it is learning material, not advice, and it never decides your grade by itself. See AI Use and Transparency.
8. No professional advice
The Service teaches judgement through simulation. Calculations, recommendations, model answers and AI replies are designed for practice in fictional settings and may simplify reality. Do not rely on them for real operational, engineering, security, financial or legal decisions.
9. Availability and changes
We work to keep the Service available and secure, but unless your Institution's agreement says otherwise we do not promise uninterrupted availability. We may change, add or remove features; if a change materially reduces what your Institution has contracted for, we will tell the Institution in advance.
10. Suspension and ending
You may stop using the Service at any time. We may suspend or end your access if you break these Terms or the Acceptable Use Policy, if required by law, or if your Institution asks us to. Where reasonable, we will tell you why. Sections that by their nature should survive (ownership, disclaimers, liability, governing law) survive the end of these Terms.
11. Disclaimers
To the extent the law allows, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Nothing in these Terms excludes rights you have as a consumer that cannot be excluded by contract.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill, arising from your use of the Service. Where you use the Service free of charge as an individual, our total liability to you is limited to the amount you paid us in the twelve months before the claim, if any. For Institutions, liability is governed by their agreement with us. Nothing here limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or for anything else that cannot lawfully be limited.
13. Governing law and disputes
These Terms are governed by Türkiye Law. The courts of Türkiye Courts have jurisdiction, without prejudice to any mandatory right you have as a consumer to bring proceedings in the courts of the country where you live. Before going to court, please contact us at info@itspracticing.com; most problems are resolved faster that way.
14. Changes to these Terms
We may update these Terms. We will show the new effective date above and, for material changes, tell Institutions and signed-in users in advance. If you keep using the Service after a change takes effect, the new Terms apply; if you do not agree, stop using the Service.
